Wholesale & Trade Terms

Who these terms apply to

These terms apply to businesses that have been given access to our trade pricing and to anyone purchasing from us as a trade buyer. Private clients purchase under the terms stated on their individual quotation.

Access and confidentiality

Trade access is granted to a business, not an individual, and the access phrase must not be shared outside that business. Trade pricing, parcel lists and availability are confidential and may not be published or forwarded without our written consent. We may withdraw access at any time.

Quotations

All prices are in Canadian dollars and exclude applicable taxes, shipping and insurance unless the quotation says otherwise. Quotations are valid for 7 days from the date issued and are subject to prior sale. A quotation becomes an order when we confirm it in writing.

Taxes

Applicable Canadian taxes, including HST where it applies, are shown on the invoice. Buyers outside Canada are responsible for any import duties, taxes and brokerage fees in their own country.

Payment

Goods are released on receipt of payment in full unless the invoice states other terms. Orders for stones or pieces procured specifically for a buyer require a deposit of 50 percent before we source the item, with the balance due before release. Deposits on procured-to-order items are not refundable once the item has been secured on the buyer's behalf.

Accepted payment methods are stated on the invoice. We do not store card numbers.

Memo and approval

Items sent on memo remain the property of Atlantic Gems until paid for in full. From delivery until return or payment, the recipient is responsible for the items and for insuring them for the value stated on the memo. Memo items must be returned, unaltered and in the same packaging, within 7 days of receipt unless a different period is agreed in writing.

Shipping and risk

We ship by insured courier with signature on delivery. Risk passes to the buyer on delivery. Shipping and insurance are charged at cost unless included in the quotation. Buyers may arrange their own insured collection by agreement.

Inspection and returns

Please inspect goods on receipt. Stock items may be returned within 5 business days of delivery if they are unaltered, unmounted and in their original sealed packaging, and if you tell us within that period that they are coming back. Items that have been set, cut, polished or otherwise worked, and items procured to order, cannot be returned except where our description was incorrect.

Consignment sale

If you place an item with us for sale on consignment, we sign a written consignment agreement before the item is offered. The agreement records the item's description and condition at intake, the reserve price below which we will not sell, the commission payable to us, the consignment period, and who insures the item while it is in our custody.

We settle with you within 14 days of receiving cleared payment from the buyer. Unsold items are returned at the end of the consignment period in the condition recorded at intake.

Disclosure

Every sale is subject to our Certification & Disclosure Policy. Trade buyers are responsible for passing the disclosures we make on to their own customers.

Export and compliance

Buyers are responsible for complying with the laws that apply to them, including any import, export and resale requirements in their own jurisdiction. We may ask for business identification before granting trade access or releasing goods.
